Expect dismal fourth-quarter numbers for Fannie Mae (FNM) and Freddie Mac (FRE), as the Treasury moves to pacify the markets by lifting their total credit facilities beyond $400 billion.
With that move, largely ignored in the holiday rush, the White House deftly avoids a nasty, negative headline criticizing the two biggest basket cases in the markets, publicly traded companies who got the biggest total bailouts of all because they are hostage to the Congress’s every housing desire.
Fannie and Freddie are portraits in miniature of a government distorted housing market getting a government bailout. Amid rising defaults, both made unusual disclosures recently, noting that the government's pressure on them to assist the housing market could cost taxpayers.
But by lifting their credit lifelines, Congress avoided yet another bailout for Fannie and Freddie from an already embattled, bailout-happy Congress.
At the same time, the Administration and Congress avoid the criticism that Fannie and Fred are getting more taxpayer money even though their executive compensation is not subject to the pay czar’s limits, because they were bailed out before the pay czar’s strictures were put in place.
Unlike Citigroup (C), Bank of America (BAC), AIG (AIG), Chrysler, and GM, Congress deemed that Fannie Mae and Freddie Mac had not received "exceptional assistance" and therefore did not have to have their pay decisions scrutinized by the pay czar.
Top executives of Fannie and Freddie could get paid as much as $6 million for 2009, despite the companies' horrendous performances this year.
The government has already doubled the lifeline provided to Fannie and Freddie in May 2009 (from $100 billion each to $200 billion each) and reports indicate that the two had wanted the administration to double that lifeline again (to a total of $800 billion). Fannie so far has received $60 billion, Freddie $51 billion from taxpayers.
Fannie Mae and Freddie Mac finance mortgages by buying them from lenders and selling them to investors. Together, they own or guarantee almost 31 million home loans worth about $5.5 trillion, or about half of all mortgages, reports indicate. The two also have hundreds of billions of dollars more in securitizations stuffed off their balance sheets.
Under the Treasury’s new flexible financing formula, Fannie and Freddie get more taxpayer support based on a formula that takes into account how much each company loses in a quarter.
Even after the companies were forced into conservatorship, the Obama administration has continued to use them as tools to promote the administration's efforts to keep some air in the rapidly deflating housing bubble.
These efforts have come at a time when the performance of their portfolios has continued to decline and the Administration's plans to address foreclosures have not worked.
What To Expect from Freddie and Fannie in the Fourth Quarter?
- Freddie: Freddie posted a net loss of $5 billion in the third quarter of 2009 and has posted a net loss of $14 billion over the first three quarters of the year. The delinquency rate on Freddie's single-family mortgage portfolio jumped 18 basis points to 3.72% in November 2009 and has more than doubled over the last year (in November 2008 it was only 1.52%). Freddie's multifamily loan delinquency rate rose to 0.14% in November 2009 from 0.12% in October 2009, and has increased by a factor of 14 over the past year (it was just 0.01% in November 2008)
- Fannie: Fannie posted a net loss of $18.9 billion for the third quarter of 2009 and has posted a net loss of $56.8 billion for the first nine months of 2009. The "serious delinquency rate" on Fannie's single-family mortgage portfolio jumped 27 basis points to 4.72% in September 2009 and has increased by 3% over the past year (in September 2008 it was only 1.72%). Fannie's multifamily loan delinquency rate 6 basis points to 0.62% in September 2009 and is almost four times the September 2008 delinquency rate (0.16%).
Meanwhile, according to Fox News analyst James Farrell, a recent report from the Office of the Comptroller of the Currency and the Office of Thrift Supervision stated that:
* Nearly 40% of homeowners who had their monthly payments cut by 20% or more last year pursuant to mortgage modification programs were delinquent again within a year.
* Although banks participating in the White House's loan modification program have offered trial loan modifications to 760,000 eligible borrowers since it was launched in March 2009, as of November only 31,000 of them had been made permanent. Why? Poor borrowers. About the same number of homeowners had dropped out of the program or had been found to be ineligible (a permanent modification requires the borrower to make at least three on-time payments as well as prove income)
* 6.2% of all mortgage loans nationwide were seriously delinquent (which is 60 days or more past due) and an additional 3.2% of all loans are in the process of foreclosure.
* Delinquency among prime mortgages, which is the largest and highest-quality mortgage category, rose sharply.
* Only 92% of loans owned or insured by Fannie Mae or Freddie Mac are performing – down from 93% in the second quarter of 2009.
* Only 83% of loans guaranteed by the Federal Housing Administration or Veterans Benefits Administration are now listed as "performing" – down from 85% in the second quarter of 2009 and below the national average of 87% for the third quarter.
Finally, a Confession
The Administration's efforts to use Fannie and Freddie to promote its efforts to prevent foreclosures come at a significant cost to U.S. taxpayers. Both Fannie and Freddie admit as much in the following disclosures in their recent financial statements, says Fox News analyst Farrell:
Freddie: "We changed certain business practices and other non-financial objectives to provide support for the mortgage market in a manner that serves public policy, but that may not contribute to profitability. Some of these changes increase our expenses, while others require us to forego revenue opportunities in the near term."
Fannie: "In connection with our public mission to support liquidity and stability in the secondary mortgage market, and in addition to the investments we undertake to increase the supply of affordable housing, FHFA, as our conservator, and the Obama Administration have given us an important role in addressing housing and mortgage market conditions. ... Our financial results are likely to suffer, at least in the short term, as we expand our efforts to assist the mortgage market, thereby increasing the amount of funds that Treasury is required to provide to us and further limiting our ability to return to long-term profitability."
Even more worrisome are Fannie and Freddie's blunt acknowledgement that they cannot predict or quantify how much the Obama administration's dictate to blindly follow its programs will cost U.S. taxpayers:
Freddie: "At present, it is difficult for us to predict the full impact of the MHA Program [loan modification] on us. However, to the extent our borrowers participate in HAMP in large numbers, the costs we incur, including the servicer and borrower incentive fees, could be substantial."
"Under HAMP, Freddie Mac will bear the full cost of the monthly payment reductions related to modifications of loans we own or guarantee, and all servicer and borrower incentive fees, and we will not receive a reimbursement of these costs from Treasury."
"In addition, we continue to devote significant internal resources to the implementation of the various initiatives under the MHA Program. It is not possible at present to estimate whether, and the extent to which, costs, incurred in the near term, will be offset by the prevention or reduction of potential future costs of loan defaults and foreclosures due to these initiatives."
Fannie: "Prior to the conservatorship, our business was managed with a strategy to maximize shareholder returns, while fulfilling our mission. However, in this time of economic uncertainty, our conservator [the US government] has directed us to focus primarily on fulfilling our mission of providing liquidity, stability and affordability to the mortgage market and to provide assistance to struggling homeowners to help them remain in their homes."
"As a result, we may continue to take a variety of actions designed to address this focus that could adversely affect our economic returns, possibly significantly, such as: increasing our purchase of loans that pose a higher credit risk; reducing our guaranty fees; refraining from foreclosing on seriously delinquent loans; increasing our purchases of loans out of MBS trusts in order to modify them; and modifying loans to extend the maturity, lower the interest rate or defer the amount of principal owed by the borrower."
"Activities of that type may adversely affect our economic returns, in both the short term and long term. These activities also create risks to our business and are likely to have short- and long-term adverse effects on our business, results of operations, financial condition, liquidity and net worth."
Fannie continues: "Other agencies of the U.S. government or Congress may also ask us to undertake significant efforts in pursuit of our mission. For example, under the Administration’s Making Home Affordable Program, we are offering the Home Affordable Modification Program. If our borrowers participate in this program in large numbers, we expect to incur substantial costs as a result of modifications of loans we own or have securitized."
"These costs include the incentive fees we will provide our servicers and borrowers and fair value loss charge-offs against the 'Reserve for guaranty losses' at the time we acquire loans, which we must do prior to any modification."
"This program will therefore likely have a material adverse effect, at least in the short term, on our business, results of operations, financial condition and net worth."

WASHINGTON -- With the front line of defense for unemployed Americans crumbling, the jobless are facing potentially reduced benefits, and businesses -- possibly higher taxes.
So far, 25 states, including California, New York, Texas and Michigan, have run out of unemployment insurance money and have borrowed $24 billion from the federal government -- loans that are interest free.
By 2011, 15 more states will have exhausted their jobless trust funds and need $90 billion in loans to keep handing out benefit checks, according to federal projections.
The federal government, however, is already up to its eyeballs in red ink, finishing fiscal year 2009 with an all-time high $1.42 trillion deficit and likely to top that this fiscal year as it extends unemployment benefits.
In November, President Obama signed legislation to extend jobless benefits by 14 weeks nationally and by an additional six weeks after that for states with unemployment rates of 8.5 percent or higher. The bill would pay nearly 1 million workers an average $300 per week in extra benefits, according to the White House, and would allow businesses to recoup past tax payments for recent losses.
Some analysts say in the long term, the bailout won't have a lasting impact on state coffers. That's because typically employers pay into a state insurance fund through a payroll tax and eventually businesses will replenish the trust funds.
In the short run, though, state governments are under pressure either to hike taxes or to reduce unemployment benefits at a time when the U.S. economy has been weakened by the longest recession since World War II.
"Everyone agrees that's not a good thing to do when the unemployment rate is 10 percent," said Gary Burtless, a senior fellow in economic studies at the Brookings Institution and an expert on labor policy.
Burtless said payroll taxes, which on average nationally is about 0.6 percent, are too low and states should have been imposing higher taxes to avoid running out of money.
"States are supposed to build up reserves to withstand severe recessions that they have experienced in the past," he said. "But instead, what happens, once employers in a state see there's a positive balance in the trust fund, they begin urging state legislators to cut back taxes."
The states with the lowest average payroll taxes are Virginia, (0.23), New Hampshire (0.25), South Dakota (0.26), Hawaii (0.27), and Texas (0.27). By contrast, the states with the highest average payroll taxes are Alaska (1.29), Rhode Island, (1.17), Michigan (1.08) and Oregon, (1.02).
According to November unemployment rates from the Bureau of Labor Statistics, Virginia had 6.6 percent unemployment, New Hampshire's was 6.7 percent, South Dakota saw 5 percent unemployment, Hawaii had 7 percent and Texas 8 percent -- all below the national average of 10 percent.
Alaska's unemployment rate in November was 8.7 percent, Rhode Island's was 12.7 percent, Michigan, 14.7 percent and Oregon, 11.1 percent.
Analysts dismiss any correlation between a state's payroll tax and its unemployment rate, saying the payroll tax is very minimal compared to taxes for Social Security or Medicare.
Richard Hobbie, executive director of the National Association of State Workforce Agencies, said he expects states to raise payroll taxes and cut unemployment benefits as a result of the recession.
"History shows it's a combination of the two" that is required to overcome the trust fund deficit, Hobbie said.
Hobbie said some states, like Texas, would rather keep employer taxes low to stimulate the local economy and borrow money when reserves aren't sufficient to weather a recession.
"There are competing philosophies about reserves," he said, adding that it is unknown which one is most effective.
But Burtless said raising taxes would solve the imbalance.
"I imagine that if they raise the payroll tax by .1 or .2 percent in the next five or 10 years, it will be enough to eliminate the insufficiency of the funds," Burtless said.
Borrowing money from Uncle Sam won't remain free for states forever. If a state doesn't repay the government within a few years, it faces interest and penalties.
Still, borrowing by states is not unusual.
"The bottom line, the system has been through serious recession before but the system has survived," Hobbie said, adding that recoveries from the major recession in the 1970s and 1980s was bolstered by strong economic growth. "The real question is will we have the steady economic growth to recover the way we did before?"
WASHINGTON -- Two strange bedfellows have asked Attorney General Eric Holder to investigate President Obama's right-hand man, chief of staff Rahm Emanuel, for his potential role in the near collapse of mortgage giants Fannie Mae and Freddie Mac.
The letter by Jane Hamsher, founder of the liberal Firedoglake Web site, and Grover Norquist, Americans for Tax Reform Chief, was sent Wednesday, one day before the Treasury Department announced that it will lift the $400 billion financial cap on loans to the government-sponsored enterprises to make sure they stay afloat.
It also arrived just before the Federal Housing Financial Authority announced Thursday that it would place salary caps on 11 of the companies' top executives.
Hamsher and Norquist want to know now whether the bailout was in part the result of corrupt practices by Emanuel while he was a board member at Freddie in 2000-2001.
They cited a Chicago Tribune story that described a plan by the executives and the board to use accounting tricks to show shareholders they were reaping massive profits even as they continued down a path of risky investments. The profits were then used to justify the executives' big bonuses. When Emanuel left the board to enter Congress in 2002, he was qualified for $380,000 in stock and options and $20,000 cash.
The two wrote they would like the Justice Department to "begin an investigation into the cause of Fannie and Freddie's conservatorship, into Rahm Emanuel's activities on the board of Freddie Mac (including any violations of his fiduciary duties to shareholders), into the decision-making behind the continued vacancy of Fannie and Freddie's inspector general post, and into potential public corruption by Rahm Emanuel in connection with his time in Congress, in the White House, and on the board of Freddie Mac."
Since the financial bailout began, Fannie and Freddie have received $111 billion in taxpayer loans. In August, the administration projected the cost for rescuing Fannie and Freddie would total $170 billion.
Treasury Department officials said the cap will be replaced with a flexible formula to ensure the companies can stand behind the billions of dollars in mortgage-backed securities they sell to investors.
"The amendments to these agreements announced today should leave no uncertainty about the Treasury's commitment to support these firms as they continue to play a vital role in the housing market during the current crisis," the department said in a statement.
FHFA issued its own ruling Thursday that the base salary for officers besides the CEO, CFO and COO cannot exceed $500,000 a year. That means five officers are exempt and 11 will now face a cap.
The capped executives will be allowed to get up to one-third of their salary in additional incentive bonuses. Any deferred cash salary -- like stock salary received by private company executives who received bailouts -- will be paid partly as a means to keep executive officers working at the GSEs.
FHFA acting chief Edward DeMarco said the compensation deal is to mimic the one set up by pay czar Kenneth Feinberg for private companies.
"The enterprises must attract and retain the talent needed to accomplish (their) objectives. We have worked with the enterprises' boards and sought the guidance of the Special Master of TARP Executive Compensation, to develop competitive compensation packages that benefit from the structural standards created for the TARP-assisted firms," DeMarco said.
Eight of the then-top 11 executives at Fannie Mae left the company just before the U.S. government stepped in with its bailout, as did the four highest paid executives at Freddie
Mac.
Treasury officials will provide an updated estimate for Fannie and Freddie losses when President Obama sends his 2011 budget to Congress in February. The formula Treasury will use will provide the institutions with a sufficient cushion based on the losses they may incur over the next three years.
In their letter to Holder, Hamsher and Norquist wrote that the White House has stonewalled any inquiries into Emanuel's role on the board, noting that the acting inspector general was "stripped of his authority earlier this year by the Justice Department, relying on a loophole in a bill Mr. Emanuel cosponsored and pushed through Congress shortly before he left for the White House."
The White House has not appointed a new inspector general to determine whether crimes were committed by the board to defraud investors, the two noted, and the statute of limitations for empaneling a grand jury is about to run out.
"Under the influence of Rahm Emanuel, the White House is moving a trillion-dollar slush fund into corruption-riddled companies with no oversight in place. This will allow Fannie and Freddie to continue to purchase more toxic assets from banks, acting as a back-door increase of the TARP without congressional approval," Hamsher and Norquist wrote.
Asked about the letter on Thursday, White House spokesman Bill Burton did not address the allegations, saying, "I have the feeling that Rahm's job is very safe."

WASHINGTON – U.S. government officials tell The Associated Press that the Nigerian man charged with trying to destroy a jetliner came to the attention of U.S. intelligence in November when his father went to the U.S. embassy in Abuja, Nigeria, to express his concerns about his son.
A congressional official said Umar Farouk Abdulmutallab, a 23-year-old Nigerian, popped up in U.S. intelligence reports about four weeks ago as having a connection to both al-Qaida and Yemen.
Another government official said Abdulmutallab's father went to the embassy in Abuja with his concerns, but did not have any specific information that would put him on the "no-fly list" or on the list for additional security checks at the airport.
Neither was the information sufficient to revoke his visa to visit the United States. His visa had been granted June 2008 and was valid through June 2010. Both officials spoke on condition of anonymity because neither was authorized to speak to the media.

For Arrow Trucking drivers like Jenn Cruthis, it was the worst of times.
The Tulsa, Okla., company wouldn't pay for simple repairs on her first truck. So Ms. Cruthis used $787 of her own money to get a second truck back to Arrow Trucking headquarters about a week ago. Mechanics sent her home: They wouldn't be fixing her truck until after the New Year for lack of funds, they said. As she was driving home to Georgia, she got a call telling her to come back.
The next morning, Arrow Trucking suspended its operations, shuttered its Tulsa headquarters, and shut off its fuel cards, leaving some of its 1,400 or so drivers stranded around the country with no fuel to get back home. Now back in Macon, Ga., Cruthis and dozens of other truckers have banded together to help their stranded bretheren.
"The way these truckers are getting out there and helping each other is amazing," Cruthis says. "They’ll sit on the radio and curse at each other all day and fight all day and then for them to stand up and help everybody like this? It's great."
The Owner-Operated Independent Drivers Association (OOIDA) put together a Facebook page where truckers have been posting their routes in case they can pick up stranded Arrow drivers along the way. OOIDA has helped half a dozen truckers get home so far, wrote spokeswoman Norita Taylor in an e-mail. Truckers from Michigan to Alabama chimed in with their phone numbers and upcoming routes, offering free rides, laundry at their homes, and hot meals.
By Tuesday afternoon, Daimler Trucks was offering bus tickets home to Arrow drivers who turned in their Freightliner trucks to a Freightliner dealer. On Wednesday morning, Navistar was offering bus tickets or $200 to Arrow drivers with International trucks.
"We're a good corporate citizen and it's the holidays," says Roy Wiley, a spokesman for Navistar. Also, "they're our trucks. We want to make certain [the drivers] take care of them."

Compounding trucker frustration is the fact that because Arrow has not formally fired its employees or gone bankrupt but only suspended operations. That makes it impossible for employees to file for unemployment benefits.
After talking with a lawyer, Cruthis says she aims to go to small claims court to settle the $787 she spent to move her truck from Nebraska to Oklahoma.
For Arrow Trucking's long-time employees, however, the company's mysterious collapse was tough to take so close to the holidays.

HAVANA, Dec 21 (Reuters) - Cuba accused U.S. President Barack Obama on Monday of being "imperial, arrogant" and dishonest during last week's global climate conference in the latest sign of deteriorating relations between Havana and Washington.
Cuban Foreign Minister Bruno Rodriguez said in a televised press conference that Obama lied during the United Nations summit in Copenhagen and is making a habit of it after less than a year in office.
"He lies all the time, deceives with demagogic words, with profound cynicism," Rodriguez told reporters.
"In this summit there was only an imperial, arrogant Obama who doesn't listen, who imposes positions that even threaten developing countries," he said.
